Appeals court orders new sentencing hearing
The AI video dispute in Arizona led to the overturning of a 10-year prison sentence in a murder case tied to road rage. Gabriel Paul Horcasitas was convicted of fatally shooting 37-year-old Christopher Pelkey in a 2021 confrontation at a red light. But the state appeals court ruled that the AI-assisted video shown at the sentencing hearing was procedurally improper and ordered that the defendant be resentenced.
The decision came after a request from the defense team. Horcasitas’s attorney, Kristen Reller, had objected to the family-produced video being presented to the court at sentencing; she did not comment after the ruling.

Judge Todd Lang, who heard the case, had said during sentencing that the video reflected both the family’s anger and a message of forgiveness, and that he viewed that approach positively.
