Timeline changed after the lawsuit
Illinois officials and the industry groups challenging the crypto tax have reached a new schedule. According to a filing submitted Thursday to the Sangamon County Circuit Court, the 0.2% tax on digital assets will now take effect on July 1, 2027 instead of January 1, 2027.
The crypto and blockchain advocacy group Digital Chamber, which filed the lawsuit, argues that the measure was added to the state budget without enough debate or public feedback. The organization took legal action in July against Illinois Attorney General Kwame Raoul and Department of Revenue official David Harris.
What was the reason in the court filing?
In a joint filing submitted to the court, the parties said the delayed effective date would allow the legal issues to be reviewed in an orderly way. The filing also said the postponement would not materially harm either side’s rights, claims or defenses.
What did the law require for brokers?
The tax was added to a Senate bill that formed part of Illinois’ 2027 fiscal year budget. The measure was signed into law in June by Governor JB Pritzker.
Under the law, crypto brokers were required to apply the tax to digital asset transactions. Noncompliance could have triggered jail time and fines.

Industry lawsuits and market impact
Digital Chamber CEO Cody Carbone called the delay a significant win for the industry. Still, Carbone said,
"Delay does not mean cancellation"and added that the group will continue pursuing the case to eliminate the tax entirely.
The case is proceeding separately from lawsuits filed in August by Crypto Council for Innovation and Blockchain Association. Those groups challenged the tax on constitutional grounds and sought an injunction to block its January 1 rollout. As of Thursday, the status of those cases was unclear after the six-month delay agreement.
From a market perspective, the postponement has pushed back near-term compliance pressure and possible enforcement risk for crypto brokers operating in Illinois. Even so, uncertainty remains over whether the tax will ultimately be repealed.
