What is inheritance renunciation and why does it arise?
Inheritance renunciation is the legal declaration by which an heir states that they do not accept the estate transferred to them. This option becomes especially important when the estate includes not only real estate, money or rights, but also inheritance debts. The aim is to avoid becoming personally liable for the deceased’s debts with one’s own assets.
Under Turkish law, this is an official application made through a statement of intent. If an heir does not clearly set out their position regarding the estate, they may in some cases be deemed to have accepted the inheritance, so the process must be handled carefully.
Where and how is the application made?
In practice, an application to renounce an inheritance is submitted to the competent Civil Court of Peace (Sulh Hukuk Mahkemesi). The application can be made by having an oral statement entered into the record or by filing a written petition. Since the documents required may vary depending on the file, it is useful to obtain up-to-date information from the court registry or a legal expert.
Basic information and documents that may be requested in practice
- Records or documents showing heir status
- Identity information and the applicant’s clear statement of intent
- If available, file details related to the estate, claims and debts, or death records
The most critical point in the application is to state unambiguously that the inheritance is being rejected. The heir should also be careful not to manage the estate, carry out transactions that could raise suspicion of asset concealment, or take any action that could be interpreted as acceptance.
What happens if the inheritance-renunciation period expires?
The inheritance-renunciation period generally starts from the date the heir learns of the death and their status as an heir. If this period is missed, legal consequences may arise on the basis that the inheritance was not renounced and is therefore deemed accepted. This increases the risk that estate debts will be directed at the heirs.
That said, the circumstances of each case are different. The calculation of the deadline, the condition of the estate, the actions of other heirs and claims that the estate is insolvent are each assessed separately. Especially if it is argued that the estate is clearly insolvent, different legal remedies may come before the court.
What to keep in mind if the deadline is missed
Missing the deadline does not automatically mean that all options are closed. However, at this stage, a case-specific legal assessment matters more than individual interpretation. To avoid losing rights, the safest approach is to have the application, objections and evidence process reviewed with the help of a lawyer.
