What does a guardianship case mean?
A guardianship case is a judicial process that comes into play when a person is unable to handle their affairs on their own or needs legal protection. In this process, the civil peace court (sulh hukuk mahkemesi) evaluates the person's situation and need for protection and may decide to place them under guardianship or appoint a guardian.
The guardianship regime covers not only the management of assets, but also representation, everyday transactions and the supervision of certain legal acts. Under Turkish civil law, the main purpose is to prevent the person from suffering a loss of rights and to ensure that transactions are carried out under court supervision.
When can a guardian be appointed?
Guardian appointment may be considered when the grounds for incapacity set out in the law arise. However, not every application automatically leads to a guardianship order; the court examines the specific circumstances of the case, the documents submitted and, where necessary, expert opinions.
- An adult who, because of health problems, cannot follow their affairs properly
- A person who puts themselves or their assets at serious risk due to wastefulness, addiction or poor management
- Minors who need representation and are not under parental custody
- A person who cannot carry out legal transactions alone because of other reasons affecting legal capacity
The key issue in these cases is whether there is a real need to protect the person. Not every health problem, advanced age or temporary difficulty will by itself lead to guardianship; the court makes a proportional assessment.
How does the process work, and what powers does a guardian have?
What factors does the court examine?
The application may be brought by the person's relatives, other interested parties or, where necessary, by the competent authorities. If possible, the court may hear the person and take their statement; if health is at issue, it may base its assessment on medical reports and other documents.
What happens after a guardian is appointed?
The guardian takes on a representative role in the best interests of the person under guardianship, but this authority is not unlimited. In particular, court approval may be required for major asset transactions, dispositions concerning real estate or steps that may create long-term obligations.
A guardianship order may mean that the person can no longer carry out certain legal acts directly; at the same time, its main purpose is to provide protection. Because each case is assessed according to its own circumstances, it is important to act in light of current legislation and professional legal advice before applying.
